Avenfield Reference: How can the acquittal of Maryam Nawaz benefit the Muslim League-N?


 In the Avenfield reference, Mian Nawaz Sharif was sentenced to ten years, Maryam Nawaz to seven years and Captain retired Muhammad Safdar to one year in prison and fined. Now Maryam Nawaz and Captain Safdar have been acquitted in this case. 

The Islamabad High Court has acquitted Pakistan Muslim League-N's Vice President Maryam Nawaz Sharif and her husband Captain Retired Muhammad Safdar Awan in the Avenfield reference on Thursday.

Maryam Nawaz and Captain Safdar had filed an appeal against the convictions of the NAB accountability court in the Avenfield reference, which the court acquitted them both.

A two-member bench of the Islamabad High Court said in a brief written decision that the reasons for acquittal and approval of the appeals of Maryam Nawaz and Captain Safdar will be issued later. 

According to some political and legal experts, now Maryam Nawaz will be able to participate in practical politics in a more confident manner and it is also possible that she will be able to get a position in the government.

According to the observers, while Maryam Nawaz benefited from this decision, it also paved the way for the return of her father and three-time former Prime Minister of Pakistan Nawaz Sharif to Pakistan. 

Legally, if a co-accused is acquitted in a case, the benefit of this goes to the other accused as well. 

What was the decision of the accountability court in the Avenfield reference?

It should be remembered that Islamabad's Accountability Court had sentenced three people during the PML-N regime in 2018, including former Prime Minister Nawaz Sharif, his daughter Maryam Nawaz and son-in-law Capt. Retired Muhammad Safdar was included.

Apart from this, he also ordered the initiation of proceedings to declare Nawaz Sharif's sons Hasan Nawaz and Hussain Nawaz as advertisers. In 2018, the accountability court of Islamabad sentenced Maryam Nawaz to seven years in prison and 2 million fine in the Avenfield reference. was sentenced to a fine of British pounds, while her husband, retired Captain Safdar, was sentenced to one year in prison. Former Prime Minister Nawaz Sharif was also sentenced to eleven years in prison and fined 8 million British pounds in the same case, while Maryam Nawaz was sentenced by the court. And her husband's case was dismissed.

This reference came to light when on April 20, 2017, the Supreme Court of Pakistan ordered a six-member team headed by a senior officer of the Federal Investigation Agency (FIA) for further investigation against the then Prime Minister Nawaz Sharif in the Panama Leaks case verdict. Ordered to form a member JIT.

Subsequently, NAB made three different references against former Prime Minister Nawaz Sharif, including the Avonfield reference which was related to property in London, while the Al-Azizia Steel Mills reference and the Flagship Investment reference were included.

Among them, Nawaz Sharif was convicted in the Avenfield reference and Al-Azizia reference, while he was acquitted by the accountability court in the flagship reference. Nawaz Sharif and Maryam Nawaz filed an appeal against these sentences in the Islamabad High Court. had gone, on which the summary decision has now come out.

Journalist and analyst Sohail Waraich says that this decision has obviously improved Maryam Nawaz's position in the party and the country. She will now be able to do politics with more confidence. 

According to him, Maryam Nawaz can now be included in the government and she can also get a political position. 

On the other hand, Sikander Bashir Mohmand keeps a close eye on legal issues. He has also been a lawyer in the Supreme Court in the Panama case against the PML-N. While talking to BBB, he said that 'Maryam Nawaz has got relief on merit.

Detailed reasons are yet to come as to why the court has acquitted Maryam Nawaz and her husband Captain Safdar. 

However, according to Sikandar Mohmand, NAB left so many loopholes and gaps in the prosecution of the Avenfield reference that the decision of acquittal came in the appeal. Maryam Nawaz and Captain Safdar were accused of assisting in this case while Nawaz Sharif is the main accused in this reference. 

He said that he could not comment on the timing of this decision, but it is certain that the NAB has not yet told in the trial what is the value of the Avonfield apartment in London and how it becomes a case of assets in excess of income.

According to journalist Farah Zia, this decision also gives the impression that when a party has to be pushed back in Pakistan, then the cases against them become effective, but when they get relief, then the situation changes completely, like Now visible. 

According to him, Ishaq Dar has also returned to the country and now he is also looking after the affairs of the treasury with confidence. Sohail Waraich says that 'N-League has not received good news for a long time. They are out of trouble. His hands were tied and now it can also be said that in the light of today's decision, the way for Nawaz Sharif's return to the country has been paved. 

In response to a question, Sohail Waraich said that Imran Khan and Tehreek-e-Insaf will now accept this decision. According to him, the narrative of Muslim League will be strengthened by this decision. 

Sikandar Mohmand says that if an accused person is acquitted in the case, then others also benefit from it, but the case here is that Maryam Nawaz and Captain Safdar were accused of aiding and abetting and thus they cannot be called co-accused.

According to him, Nawaz Sharif will also get the same benefit in this reference that mistakes have been made in the prosecution from NAB.

 Whereas, according to Farah Zia, the question of political inheritance within the PML-N will also be raised with the acquittal of Maryam Nawaz. According to him, this decision has also given a victory to the narrative of PML-N that we were targeted, we have faced the courts and got acquitted. 

It should be noted that Maryam Nawaz while talking to the media outside the Islamabad High Court said to a question that she has been getting pushed in the courts for many years and then she got justice somewhere. 

It should be noted that Maryam Nawaz and Captain Safdar have also been sentenced to jail in this case. He was in jail during the 2018 general elections and was not even eligible to contest the elections after being convicted by the court.

In response to a journalist, Maryam Nawaz said that the person who created and conducted these cases is currently somewhere on the sidelines and is watching all this from there.
